[00:10] Welcome to new episode of "Just A Minute" by Landmark Law. This episode is presented to you by Vicki on June 23rd, 2023, to help educate our listeners on various legal scenarios.

[00:24] Today's episode will be Part 2 on A Will Challenge.

[00:26] In Ontario, the most common grounds for a will challenge are undue influence and incapacity. Undue influence is when a will does not truly reflect the will-maker's intention because the will-maker is influenced by another party in the drafting of their will.

[00:42] Sometimes, an elderly will-maker may be heavily dependent upon another person for care or assistance, as a result, pressure may be brought to the elderly will-maker who makes a will. Incapacity means a will-maker lacks mental competence to give instructions for a will.

[01:00] The will-maker is unable to understand the nature and extent of the assets and comprehend the persons who should receive the assets. Landmark Law assists both beneficiaries and estate trustees with will challenge issues.
